Terms and conditions

This is a translation; the Romanian version prevails.

These terms govern the use of Kondito, a software platform (SaaS) for car rental and equipment hire companies, provided by CDP PIXEL AGENCY SRL. By creating an account, the company accepts these terms.

1. The service

Kondito provides fleet records, rates, customers, rentals, a calendar, photo inspections, documents and reports, available in the browser and in the field app.

The service is intended only for businesses and professionals, not for consumers.

2. The account

The person creating the account confirms they are entitled to represent the company. The company is responsible for the users it adds and for keeping sign-in details confidential.

Tell us immediately at info@kondito.com if you suspect unauthorised access.

3. Free trial

A new account gets a free 14-day trial, with no card. At the end, the account becomes read-only until a subscription is chosen; no data is lost.

4. Subscription, prices and payment

The subscription depends on the number of active products and on the chosen period (monthly, 6 or 12 months). Prices shown are final; the provider is not registered for VAT.

Payment is made in advance, by card, through Stripe, and renews automatically at the end of each period until cancelled. An invoice is issued for every payment.

The plan can be changed at any time; the difference is prorated. We may change prices with at least 30 days' notice; the new price applies from the next renewal.

5. Cancellation and non-payment

The subscription can be cancelled at any time from the application; it stays active until the end of the period already paid. Amounts paid for the current period are not refunded, except where the law provides otherwise.

If a payment fails, the account keeps full access for 7 more days, then becomes read-only until payment. Data can still be viewed and exported.

6. The company's data

The data entered in Kondito belongs to the company, which can export it at any time while the account exists. For its customers' data, the company is the controller and is responsible for the legal basis of the processing and for informing its customers; we process that data as a processor, as set out in the Privacy policy.

Photo reports, the time, location and digital fingerprint of files help document handovers and returns, but their legal weight in a dispute is assessed by the court.

7. Acceptable use

The service may not be used for illegal activities, for uploading content you have no rights to, or to try to access other companies' data or disrupt the platform.

We may suspend an account that breaches these terms, with prior notice, except in urgent security situations.

8. Availability and support

We make reasonable efforts to keep the service available at all times and make backups. Planned maintenance is announced in advance. Support is provided by email at info@kondito.com.

9. Liability

The service is provided as is. To the extent permitted by law, our total liability for any claim is limited to the amounts paid by the company in the last 12 months and does not cover indirect losses such as lost profit or lost customers.

This limitation does not apply in cases of fraud or gross negligence.

10. Changes to these terms

We may update these terms. Important changes are announced at least 30 days in advance; continuing to use the service after that date means accepting them.

11. Governing law

These terms are governed by Romanian law. Any dispute is settled amicably or, failing that, by the competent courts in Bucharest.
